Regulatory Dispute Advisory
Strategic legal-technical support for regulatory disputes and issues.

We offer strategic legal-technical support for companies facing regulatory impasses in the energy sector — integrating engineering, regulation, and legal advisory whenever needed.
Impasses with the utility, ANEEL or the Ministry of Mines and Energy require engineering and sector law to be read together.
We work on dispute resolution and on enabling benefits such as REIDI, with specialized legal advisory when needed.
Regulatory impasses in the power sector
Denied grid-access opinions, reverse power flow, distributor diligences, delays at ANEEL or the Ministry of Mines and Energy: regulatory impasses stall solar plants even when the engineering is ready. Nodal offers strategic legal-technical support so engineering and sector law are read together.
We work at the interface with the utility, ANEEL and other authorities, with specialized legal advisory when the case requires it.

REIDI for distributed mini-generation and solar
REIDI is a core incentive for energy infrastructure. For distributed mini-generation the typical flow is: form with the distributor, ANEEL review, MME classification ordinance and Federal Revenue qualification. PIS and COFINS suspension can reach 9.25% of works CAPEX for up to five years after qualification.
Nodal has led REIDI qualifications for photovoltaic plants in distributed generation — from eligibility to official publication. After approval we guide invoicing and bookkeeping so the benefit is not lost in operation.

Frequently asked questions
It is Brazil’s special incentive regime for infrastructure. It suspends PIS and COFINS on goods and services of the implementation, after MME classification and Federal Revenue qualification, including for distributed mini-generation when the project fits.
Yes. Connection impasses — reverse flow, reinforcement works, deadlines — need PRODIST, connection contracts and engineering read together. We build the strategy before the distributor and, if needed, ANEEL.
No. The ordinance classifies the project; qualification is with the Federal Revenue. The benefit then has to be used correctly on invoices and books throughout the works.
